Proposed Requirements for E&S/Stormwater Site Plan Submittal & Bond Release

Reason

Disturbance Limits will be required on the site plan (shown as limits of clearing and grading) and the total disturbed acreage will be required within the narrative.

Required by the Virginia Department of Conservation & Recreation. Limits will be required on the site plan so that the reviewer may determine whether perimeter protection is appropriate for the site.  Disturbed acreage will be required to track DCR requirements for acreage reporting.

Owner Information on Site Plan will be required on the site plan.

Since the Virginia Erosion & Sediment Control Law designates that the owner is ultimately responsible for proper E&S implementation, the owner’s name and contact information will be required on the cover sheet of the site plan so that they may be notified accordingly.

E&S/Stormwater Calculations will be summarized in accordance with the methodology detailed in “Design Summary Tables for Erosion and Sediment Control and Stormwater Management Plan Reviews” as approved by the Central Virginia Erosion and Sediment Control Committee.

In an effort to ensure consistent plan review requirements of complex technical information, the CVESCC has developed a table format that will summarize all the information required by the Virginia Department of Conservation & Recreation’s Erosion & Sediment Control Handbook for individual practices and drainage information.

The E&S/Stormwater Narrative and Calculation Summary Tables will be required on the site plan sheets.

In an effort to comply with the Virginia Department of Conservation & Recreation’s requirement that the complete plan/narrative package is present on the job site at all times, the narrative and calculation summary tables must be a included on the plan sheets of the site plan package.

Proof of VPDES Permit Application will no longer be required prior to plan approval or issuance of the locality’s grading/land disturbance permit.

Although the localities will continue to play an advisory role in notifying the designer/owner/applicant of the requirement of a VPDES for projects that disturb more than 1 acre of land, the jurisdictions will no longer require VPDES permit application/issuance to plan approval or grading/land disturbance permits due to logistical timing problems with the issuance of the respective permits.

Pre-Construction Conference will be required prior to issuance of a land disturbance/grading permit for commercial projects.

To verify that all parties have an adequate understanding of the approved site plan, the Owner and/or their Agent, the Designer and the Responsible Land Disturber must meet with the locality’s representative prior to issuance of a land disturbance/grading permit for commercial projects.  A pre-construction conference may also be required for residential projects at the locality’s discretion.

Verification of the Responsible Land Disturber will no longer be required as a condition of plan approval.

Although verification will still be required by each locality, the information will not be a requirement of the site plan

The designer will be required to submit a Bond Estimate for the project with the site plan.  A regional cost list has been developed for use in determining the land disturbance bond estimates.

The designer must submit a land disturbance bond estimate for the project with the site plan submittal.  The estimate should include costs for grading, erosion control, stormwater management and water quality measures, as applicable.  It is the locality’s discretion as to whether or not to use the bond amount as submitted.

Bond Reductions will not be granted if the project is only partially complete.

Bond reductions will not be granted (except in special cases as determined by the locality’s E&S Program Administrator) in an effort to achieve full site stabilization within a timely manner. 

Stormwater Maintenance Agreements will be required for all stormwater management facilities constructed within the localities.

Each locality will require that stormwater management systems be maintained to protect downstream properties from failure of the system.

Designer inspection/verification that the site’s drainage and stormwater management systems have been built in substantial compliance with the approved site plan will be required for Bond Release.

“As Built” Drawings or confirmation from the designer that the site’s drainage system is built in substantial compliance with the approved site plan will be required prior to bond release to ensure the proper function of the system prior to turning over to the owner/tenant for system maintenance.
